LICENSE: Viade hereby grants you (each licensee is addressed as “you”) a non-exclusive, transferable license to use Afterburner software program and accompanying documentation (the program’s object code and documentation are collectively referred to as the “product”) on the following terms:
- use the product on any computer in your possession;
- make copies of the product;
- distribute the product subject to the requirements outlined below.
By using this Viade Afterburner you are automatically agreeing to and show that you have read and understood the terms and conditions contained within this Software Program License Agreement. This Software Program License Agreement is then effective while you use and continue to make use of Viade Afterburner. If you do not agree with this Software Program License Agreement you must not use Viade Afterburner – this Software Program License Agreement will then not apply to you. This Software Program License Agreement is subject to change without notice.
TITLE: Title, ownership rights, and intellectual property rights in and to the product, and each copy thereof (including all copyrights therein), shall remain in Viade. The product is protected by the copyright laws of the United States and international copyright treaties.
FREEWARE LICENSE RIGHTS: This product is provided as freeware. Freeware products are provided free of charge. This freeware product may be used as many times as you like, for as long as you like. You may copy and distribute copies of the complete and unmodified package of this product that includes this copyright notice and disclaimer of warranty intact. You must not charge money or fees for the software product to anyone. The copyright holder reserves the right to reclassify this product as a non-freeware product at a later date (i.e. shareware, licensed royalty software, or public domain). Doing so will not modify the license agreement of previously distributed executables.
DISCLAIMER OF WARRANTY: THIS PROGRAM IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Its component parts may not be separated for any use or distribution. You may not modify, combine other commercial applications with, or otherwise prepare derivative works of this product.
NO OBLIGATION: You are solely responsible for all of your costs and expenses incurred in connection with the redistribution of the product, and Viade has no liability, obligation or responsibility for it. Viade has no obligation to provide maintenance, support, upgrades or new releases to you or to anybody else the product has been redistributed to.
In order to preserve the value of the Viade name and/or any trademarks, service marks, trade dress adopted and/or used by Viade from time to time, you shall not make use of any of them for any reason (e.g., with respect to an Additional File, in advertising, marketing your own products, press releases, or other publicity) except solely as may be expressly authorized by the prior written consent of Viade.
